3. Scope of Services
Build High provides civil construction, turnkey project execution, project management, estimation, interior execution, renovation, and related services for residential, commercial, and industrial projects across South India.
- All services are subject to availability, project requirements, and signed agreements.
- Detailed scope of work, timelines, and costs will be outlined in a separate Service Agreement or Work Order.
- These Terms apply to website usage and general inquiries. Specific project terms will be governed by individual contracts.
4. Website Use and Content
Permitted Use:

- No Obligation: Submitting a contact form or requesting an estimate does not create a binding contract. A formal agreement must be signed by both parties.
- Estimate Validity: Any cost estimate provided is valid for 30 days from the date of issue, unless otherwise stated. Prices are subject to change based on material costs, labor availability, or project scope changes.
- Site Visits: We may require a site visit before providing a final quote. Travel charges may apply for locations outside Bangalore.
- Accuracy of Information: You agree to provide accurate and complete information about your property, requirements, and budget. Inaccurate information may affect estimates and timelines.
6. Service Agreement and Contract
For any construction project, a separate Service Agreement or Construction Contract will be signed between Build High and the client. That agreement will supersede these Terms for project-specific matters and will include:

7. Payments and Fees
- Quotation Basis: All fees are provided in Indian Rupees (INR) unless otherwise specified.
- Taxes: Applicable taxes (GST, etc.) will be added to all invoices as per government regulations.
- Payment Schedule: Typically follows a milestone-based structure (e.g., 20% advance, then payments after foundation, slab casting, finishing, etc.).
- Delays in Payment: Build High reserves the right to suspend work if payments are delayed beyond the agreed due date. Interest may be charged on overdue amounts at 2% per month or as specified in the Service Agreement.
- Additional Work: Any changes or additions requested by the client after the agreement is signed will be charged extra based on a revised estimate.
8. Client Responsibilities
As a client engaging Build High for construction services, you agree to:
- Provide timely approvals on drawings, material selections, and change requests.
- Ensure the site is accessible and clear of legal disputes or encumbrances.
- Obtain necessary approvals from local authorities if not included in our scope.
- Make payments as per the agreed schedule.
- Inform us of any underground utilities, cables, or pipelines on the property.
- Allow our team reasonable access to the site during working hours.
Failure to meet these responsibilities may result in project delays, for which Build High will not be liable.
9. Project Delays and Force Majeure
Build High strives to complete all projects on time. However, we are not liable for delays caused by:
- Client-caused delays (late approvals, payment defaults, change requests).
- Government approvals or permit delays beyond our control.
- Adverse weather conditions, natural disasters, or acts of God.
- Labor strikes, material shortages, or supply chain disruptions.
- Any other event beyond our reasonable control (force majeure).
In such cases, the project timeline will be extended reasonably, and no penalties will apply.
10. Quality and Warranty
- Workmanship Warranty: Build High warrants that all construction work will be carried out with reasonable care, skill, and adherence to engineering standards.
- Defects Liability Period: Any defects arising from poor workmanship will be rectified free of cost within 12 months from project completion, as specified in the Service Agreement.
- Exclusions: Warranty does not cover damage caused by misuse, neglect, unauthorized alterations, natural wear and tear, or external factors like earthquakes, floods, or subsidence.
- Materials: Build High uses high-quality materials. However, we are not responsible for manufacturing defects in third-party products (e.g., tiles, paints, sanitary ware). Manufacturer warranties apply separately.
11. Intellectual Property
All content on our website – including text, images, logos, graphics, project photos, and videos – is the property of Build High and protected by copyright laws.
Architectural drawings, structural designs, and project plans created by Build High remain our intellectual property until full payment is received. Upon full payment, the client receives a license to use them for the specific project only.
You may not reproduce, distribute, or share our designs or drawings without written permission.
12. Limitation of Liability
To the maximum extent permitted by law:
- Build High's total liability for any claim arising from our services or website shall not exceed the total fees paid by you for the specific project in the last 12 months.
- We are not liable for indirect, incidental, consequential, or punitive damages (including loss of profit, revenue, or business opportunity).
- We are not liable for damages caused by third-party vendors, contractors, or material suppliers engaged by us, beyond what we can recover from them.
13. Indemnification
You agree to indemnify, defend, and hold harmless Build High, its proprietor, managing director, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from:
- Your breach of these Terms or the Service Agreement.
- Your failure to provide accurate information or necessary approvals.
- Your violation of any applicable laws or third-party rights.
14. Termination
- By Either Party: Either party may terminate the Service Agreement with 15 days written notice if the other party commits a material breach and fails to remedy it within the notice period.
- By Build High: We may suspend or terminate services immediately if you fail to make payments, provide false information, or act in a manner that endangers our team or property.
- Effect of Termination: Upon termination, you must pay for all work completed up to that date. Any advance payments for incomplete work will be refunded after deducting costs incurred.
15. Governing Law and Dispute Resolution
- Governing Law: These Terms and any Service Agreement shall be governed by the laws of India.
- Jurisdiction: Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
- Arbitration: At Build High's discretion, disputes may be resolved through arbitration by a sole arbitrator appointed mutually, as per the Arbitration and Conciliation Act, 1996. The arbitration venue shall be Bangalore, and proceedings shall be in English.
16. Communication and Notices
Build High may contact you via email, phone, WhatsApp, or postal mail for project updates, marketing, or service-related communications.
You may opt out of marketing communications at any time by replying "UNSUBSCRIBE" or contacting us directly.
Official notices (legal, termination, etc.) must be sent in writing to our registered office address via registered post or email with read receipt.
17. Third-Party Links
Our website may contain links to third-party websites (architects, suppliers, government portals). These links are provided for convenience only. Build High does not endorse or control these websites and is not responsible for their content, privacy practices, or terms. Access them at your own risk.
18. Amendments to These Terms
Build High reserves the right to update or modify these Terms & Conditions at any time without prior notice. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after changes constitute acceptance of the updated Terms. For significant changes, we may notify you via email or website notice.
19. Severability

These Terms & Conditions, together with any Service Agreement, Work Order, or estimate accepted in writing, constitute the entire agreement between you and Build High. They supersede any prior agreements, representations, or understandings, whether written or oral, relating to the subject matter.
